How Virginia Custody Law Works

Virginia courts decide custody based on the best interests of the child under Virginia Code Section 20-124.3. The statute lists ten factors, and no single factor is automatically decisive. Courts weigh each parent’s role in the child’s daily life, their willingness to support the other parent’s relationship with the child, the child’s age and developmental needs, any history of family abuse, and the consistency each parent has demonstrated over time.

There is no presumption favoring mothers or fathers. The distinction between legal custody (decision-making authority over education, medical care, and religious upbringing) and physical custody (where the child lives) matters significantly in how orders are structured. Virginia courts regularly award joint legal custody even when primary physical custody rests with one parent.
